About this privacy statement.

This privacy statement is published in accordance with the article 13 of the d.lgs. number 196/2003, code regulating personal data protection (“Code”), and is addressed to users of the website belonging to Industria Molitoria Perteghella S.r.l. (“Perteghella”), www.perteghella.it (“Website”). This privacy statement relate to all personal data that Perteghella collects and keeps about its clients and their accounts; it doesn’t apply to data collected by other websites the client may have visited through links to third parties websites.

Types of data treated

The personal data treated by Perteghella are collected (1) when directly given by the client; (2) automatically collected.

1) Data directly given by the client are all the personal data entered in the website (to navigate, to complete online purchases or for any other reason) or made available to Perteghella with any method. Anyone whose personal data are collected can decide, within the law, not to allow the partial or total treatment of personal data. This may result in some limitations or total inability to use the Perteghella services.    

2) Automatically collected data are navigation data also known as “cookies”. IT systems and software responsible for operating the website, during their routine tasks, acquire some personal data. Their diffusion is implicit in the use of some Internet protocols. Data are usually treated at Industria Molitoria Perteghella S.r.l. headquarters.

Personal data are treated by Perteghella and /or by accurately selected trustworthy third parties. Data may be forwarded to third parties should this be necessary or opportune in order to perform activities (even instrumental or ancillary) relevant to the purpose of data treatment illustrated in this document, the main purpose being the supply of goods and services requested by the Client.

Personal data are collected respecting obligations and guarantees in line with the Code and are mainly treated using automated electronic tools, for a time strictly limited to perform the tasks for which they have been collected. Security measures are in place in order to prevent data loss, illicit or incorrect use and unauthorized access.

As soon as personal data are no longer needed for the purposes for which they were collected, Perteghella proceeds to deleting them, unless the law doesn’t mandate to archive them or the client has agreed to store them for a longer time or to have them archived.

Rights of visitors of the website.

Within article 7 of the Code, each user has the right to know whether personal data have been stored, even when they are not recorded yet, and they need to be communicated in clear form.

More in detail, each user has the right to know from Perteghella all information about: (a) the origin of personal data; (b) the purpose and methods of data elaboration; (c) the methods used by electronic tools to elaborate data; (d) the personal details of the owner and of the data controller; (e) the personal details of the subjects and subject categories to which data may be forwarded.

More, each user can ask Perteghella to update, correct, supplement or cancel personal data should they be treated illicitly or in other cases within the law, or to block any data held in violation of the law.

Lastly, each user has the right to totally or partially oppose data treatment, even when data collection is relevant to the purpose, for legitimate reasons and for sending advertisement material, for direct sales and for marketing research.

Purpose of data treatment

Data are exclusively for the purpose for which they are collected, described below:

Perteghella mainly use clients’ data to:

  1. Manage orders and complete relevant activities (example: contact with client about the order’s status, replies to clients’ requests, payments’ management).
  2. Manage the users’ accounts upon registration to the Website in order to use the service;
  3.  Allow subscribing to other services or specific services, like receiving newsletters with promotional offers and other information services, or for statistics and market research.

For the above-mentioned purposes, Perteghella may appoint external suppliers to which only and exclusively data that are strictly necessary for the required task are communicated.

Supplying data for the purposes explained at the above-mentioned points 1 and 2 is mandatory as points 1 and 2 are necessary for the sale and delivery services through the Website or to register on the website. Refusing the personal data treatment allows completing the contract with Perteghella to supply services cited at points 1 and 2. However it prevents from being updated on commercial initiatives and/or promotional campaigns, from receiving offers or other promotional material and/or from sending personalized offers to the client. Terms and conditions regulating the services offered by Perteghella are articulated in these General terms and conditions. By accepting these conditions during the registration on the Website and by using the Website, the user explicitly agrees on respecting the Website’s conditions.

Use of the Website

The User explicitly agrees and guarantees that the use of the Website and its services will fully comply with the General terms and conditions, and will not affect any other subject’s rights, will not constitute a breach of a contractual obligation or of a legal obligation towards third parties and that will not breach current laws. More the user agrees to release Perteghella from any liability, towards any subject, that may derive from a use of the Website non-compliant with these Conditions.

To register on the website www.perteghella.it real people names, company names or nicknames can be used, provided that the user is authorized to use those names or domains and that by using those the user is not in breach of any intellectual property. By registering to the Website the User agrees to release Perteghella from any liability towards any subject that may derive from using personal names, domains or registered brands, that don’t comply with current regulations.

The following is strictly forbidden:

Should the client be temporarily or permanently suspended, it won’t be possible for the user to register again using the same credentials used for the suspended account.

Contents’ property

Unless otherwise specified, the Website, its graphics and all texts, images, brands, logos and what is featured in the Website belong to Perteghella and all rights are reserved.

Perteghella, perteghella.it, the logo and all other brands featured on the Website are registered trademarks or they belong to Perteghella or to third parties that have specifically allowed to use their brands. No contents presents on the Website can be intended as a guarantee, explicit or otherwise, of a license or right to sue the brands without prior release written by Perteghella or by third parties owning the brand.

Laws and international treaties applicable to the protection of intellectual property protect the above rights. It is therefore forbidden (and may be sanctioned within civil and criminal law) any form of reproduction and redistribution, even if partial, of the Website’s layout and graphics and of the contents featured on the Website, without written authorization by Perteghella.

In particular, the User also declares and guarantees to receiving all necessary consent and approval by possible third parties, to having paid the rights and fees as required by law or in the contract, to third parties and that no third parties’ right impede the Website to receive and use the contents within the General Conditions.

Consequently, the User agrees to release from liability and exonerate Perteghella from any claim, damage, prejudice, cost or expense, including the costs for legal assistance and those that may follow court judgment against the Website should the Website incur in breach because of the user as detailed in this paragraph.

Disclaimer of warranties and limitation of liability

Within the law and apart from the consumers’ rights, Perteghella cannot guarantee the Website’s content for purposes unless differently specified for chargeable services.

It has no liability regarding the accuracy or the exclusive character of the website’s content, in particular the contents personally added by the users.

The User is exclusively responsible for the use of the website and Perteghella, apart from the chargeable services provided within the purpose of the service itself, cannot be considered contractually or non-contractually responsible, for losses or damages deriving from the Website’s use, including, without any limitations, any damage (direct, indirect, punitive or consequential) and any loss (of income, profits, goodwill, data, contracts, money use), and loss or damages deriving from business deferral  determined by the use or impossibility to use or by the outcome of the use of this Website.

Perteghella does not guarantee that the information featured on the Website are correct and, in particular, that the contents are available in the same aspect, same format and same condition even outside Italy. The User, resident in a country other than Italy, by visiting and using the Website agrees to respect all applicable laws relevant to the data and content transmission to the country where the User resides and, should the User download contents and information from the Website, the User takes responsibility to respect the law of the country of residence.

The Websites features links and banners redirecting to third party websites that are not under Perteghella’s control; Perteghella takes no responsibility for these websites’ contents or for the services they may offer. The Website supplies links and banners but this doesn’t imply in any case the approval or the affiliation with the website linked. Linked websites belong to third parties they autonomously manage. For this reason Perteghella cannot guarantee that the user will be satisfied with their products, services, or business process.

It is therefore recommended the User perform all necessary checks before starting any transaction with these subjects. Google Analytics remarketing is used through these external websites for advertisement purposes and third party suppliers use cookies to inform, optimize and publish adverts based on the previous visits of a user to a website.
